The Right To Recall Law /Vote Vapasi Kanoon

It is the power Citizens get to replace any minister, judge or official from his job anyday before their term ends. If implemented rightly, this law can reduce corruption by a huge amount and bring about honesty, efficiency and accountability in Governance .

The draft of RTR Law cannot be same for all positions. For example the draft for PM’s post will be different than that for Recall over CM post or Police Commissioners post . Hence it must always be specified with a position . For eg RTR-PM, RTR-CM, RTR Police Commissioner

The success or failure of the law depends on what the procedure entailed in the drafts is.

Most important aspects of any Vote Vapsi /RTR Law draft are :

Whether it's a Positive Recall or Negative Recall Procedure

“Positive Recall Procedure/ Sakaratmak vote vapsi prakriya” – In this method people have to first file approvals for a new replacement candidate . Only if any candidate gets required margin of approvals , then existing officer or minister steps down and the new candidate takes office. This method ensures that the seat does not remain vacant before a new person is elected to occupy it and hence does not cause instability.

, “Negative / nakaratmak ” – procedure: the incumbent(existing ) officer is first recalled by people and later on new elections are held to elect new officer/minister. This results in Instability.

We propose and support Positive (Sakaratmak) Vote Vapsi.

SIgnature Based or Biometric /Appearance Based

InSignature Based – An officer collects the Signatures of all those citizens in favor of Recall .

Cons of this :

1) Signatures can be forged

2) India does not have signatures database.

3) It is easily prone to spurious recalls initiated by opposition parties.

This results in Instability and we do not approve of it. This is Negative Recall Procedure and it’s the method proposed by Shri Arvind Kejriwal and Shri Varun Gandhi !

In Appearance Based with Biometric Verification that We Propose :

All citizens in favor of Recalling existing Official will go to Talati office on any day of the month and file approvals for 5 candidates . The results of candidate with highest approval count will be published on a day in the first week of next month . The incumbent will resign if new candidate gets higher than required threshold of approvals. This is Positive Recall Procedure which does not cause instability.

The Margin of Votes

What is the margin to be considered for Recalling :

Eliminating Vote Buying

That people vote for money and elections are won based on such votes is a myth . It’strue that before elections some money is distributed to people but not all citizens can be bribed.

Yet If the Law draft provides option to again change the Vote any day before the results are declared, then even if candidates approach people and pay money to vote for them , people can change their votes even after take the money .

Hence the provision to change vote that has been filed until the day of declaring the final count will end the problem of vote buying.

Making the process inexpensive !!

Not if implemented as proposed by us.

Every citizen filing his approvals will be paying a fee of Rs 3 (1 for BPL ) everytime he uses the facility. That will cover the cost of maintaining the Procedure.

Convenience of Voters

If citizens can go to nearest Talati’s office and cast their approvals for alternate candidates anyday, and not on any one particular day and final result is published at the end of the month , then it becomes convenient for the people to participate in the Recall process and it improves peoples participation in elections and hence Governance vastly.
